# Terms of Service

Terms for the Dronaware website, free-of-charge proprietary Testbench software, and Optical Flow firmware.

## 1. Dronaware and acceptance

**Dronaware** is the trading name of **Tushar Sharma**, sole proprietor, and an Udyam-registered MSME in India. "Dronaware", "we", and "us" refer to Tushar Sharma trading as Dronaware. By accessing a Dronaware service, completing a purchase, starting a flashing session, or using a product, you agree to these terms and the policies presented with the service. If you act for an organization, you represent that you have authority to bind it.

## 2. Testbench hosted service

Testbench is a proprietary browser-based laboratory diagnostic tool distributed free of charge. These terms do not grant rights to obtain, copy, modify, publish, redistribute, sublicense, reverse engineer, or create a competing service from Dronaware's source code or protected components. Core individual use is offered without charge. Commercial and institutional use is currently offered without charge on an introductory basis; Dronaware may introduce prospective plans or limits only after giving notice and obtaining any acceptance required for continued paid use. No retroactive charge will be imposed.

Testbench assists users in comparing optical-flow telemetry with controlled reference motion. It does not certify a sensor, aircraft, integration, component, or result, and it does not make a final safety or airworthiness decision.

## 3. Optical Flow firmware

Optical Flow is proprietary, closed-source firmware licensed, not sold. The product-specific device licence presented by the Optical Flow service (our End User License Agreement) governs its purchase, registration, flashing, updates, and use. Unless checkout expressly states otherwise, one entitlement permits the purchased firmware to operate on one registered supported device.

The purchaser may, without further permission, royalty, or licence fee from Dronaware, sell, resell, distribute, lease, or otherwise supply that physical device, including as a component of a larger commercial product, while the firmware remains installed and bound to its registered hardware. Each lawful owner or operator of that physical device may run the installed firmware solely on that device. This permission covers distribution and operation of the physical device; it does not transfer or redistribute the licence as a standalone entitlement, create another activation, or permit separate supply of firmware files, encrypted artifacts, keys, credentials, account access, or flashing access. Copying or moving the firmware to another device, selling a licence or entitlement separately, sublicensing the firmware, or providing hosted flashing for third parties remains prohibited.

This physical-device sale permission is an expansion of the licence grant and applies to every valid Optical Flow device licence, including a licence purchased or activated before 25 September 2026. Dronaware waives enforcement of an earlier contractual term solely to the extent that it required Dronaware approval for, or prohibited, a physical-device sale that satisfies the conditions above. Earlier restrictions on separate firmware, licence, entitlement, key, credential, activation, or flashing distribution remain in force.

The current Optical Flow firmware does not read a distance sensor, reports distance as unknown in `OPTICAL_FLOW_RAD`, and does not publish `DISTANCE_SENSOR`. It does not provide height or altitude. For stable hover, the integrator must install and configure a separate downward distance sensor so the flight controller receives valid distance measurements at an update rate acceptable for the selected flight controller and sensor. Any future integrated distance-sensor support is not included unless the applicable firmware release expressly provides it.

## 4. Purchases, taxes, and digital delivery

Prices, currency, taxes, quantity, supported hardware, and included releases are shown at checkout. Payment may be processed by the provider or merchant of record identified at checkout, whose payment terms also apply. A purchase is complete only after valid payment confirmation. Digital delivery may include identity verification, device registration, a time-limited flashing session, documentation, and licence records. The raw proprietary firmware is not promised as a downloadable file. Refunds are governed by the [Refund Policy](/legal/refund) and mandatory law.

## 5. Intellectual property and acceptable use

Dronaware and its licensors retain all rights in the services, firmware, source code, algorithms, documentation, branding, and related materials. The physical-device sales expressly permitted by section 3 do not convey ownership of, or a separate distribution right in, the firmware. Except where applicable law does not permit restriction, you must not extract, copy, publish, separately distribute, sublicense, or sell the firmware or a licence entitlement; reverse engineer, decompile, or disassemble it; bypass access or licence controls; interfere with the services; misuse another person's identity or purchase; or use the services unlawfully.

Third-party software components are licensed directly under their respective open-source licences. If these terms conflict with an applicable third-party licence, that third-party licence controls for the affected component only. It does not grant rights to Dronaware's proprietary software, services, licence entitlements, or branding. ## 6. Flight safety and intended use

Testbench and Optical Flow are non-certified development tools and are not flight controllers, navigation systems, obstacle- or collision-avoidance systems, certified avionics, or independent safety systems. They must not be used as the sole source for a safety-critical flight decision. Optical Flow produces relative-motion estimates that may be delayed, unavailable, inaccurate, or misleading because of hardware, surfaces, lighting, altitude, vibration, motion, configuration, processing load, integration, or other conditions.

You are responsible for hardware selection, wiring, power, installation, orientation, calibration, configuration, flight-controller integration, regulatory compliance, and deciding whether any use is safe. You must follow the current documentation and operating limitations, reject stale, invalid, low-confidence, implausible, or out-of-range data, implement timeouts and fallback behaviour, maintain an independent safe means of control, and complete bench, tethered, and controlled-area testing before flight. Revalidate after any hardware, firmware, mounting, configuration, or environmental change.

## 7. Availability and warranties

Services and documentation may change, be interrupted, or be discontinued. To the maximum extent permitted by law, the website, Testbench, Optical Flow, and related services are provided "as is" and "as available", without implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. Performance figures apply only to their stated test configuration and are not guarantees for every installation. Nothing in these terms limits an express written warranty or a right that applicable law does not allow us to exclude.

## 8. Limitation of liability

To the maximum extent permitted by law, Dronaware is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss; loss of profits, revenue, data, opportunity, goodwill, aircraft, payload, or use; or costs arising from flight interruption or replacement systems. Dronaware's aggregate contractual liability for a paid product will not exceed the amount paid for the entitlement giving rise to the claim. For a free service, aggregate contractual liability will not exceed the amount paid for that service during the twelve months before the event giving rise to the claim.

These limitations allocate contractual risk between Dronaware and the user. They do not exclude fraud, wilful misconduct, or any liability, remedy, warranty, consumer right, bodily-injury claim, product-liability claim, or third-party right that cannot lawfully be excluded or limited.

## 9. Organizational users and indemnity

To the extent permitted by law, an organization using a Dronaware product will defend and indemnify Dronaware against third-party claims caused by that organization's aircraft or system design, physical product, unsupported integration, modification, regulatory non-compliance, disregard of documented limitations, misleading product representations, or unauthorized distribution of firmware or licence entitlements, except to the extent the claim is caused by Dronaware's proven defect, breach, negligence, or unlawful conduct. This section does not apply to an individual consumer where prohibited by law.

## 10. Suspension and termination

Dronaware may suspend access for fraud, security threats, chargeback, unauthorized distribution, activation abuse, or material breach. Where reasonably curable, we will give notice and a reasonable opportunity to cure. Termination does not remove accrued payment obligations or provisions intended to survive. A refund or payment reversal may deactivate the related entitlement.

## 11. Governing terms and changes

These terms are governed by the laws of India, without overriding mandatory consumer protections or the jurisdiction of a court that applicable law requires. If a provision is unenforceable, the remainder continues in effect. We may update these terms prospectively by publishing a new dated version; material changes will be communicated where required. Changes will not retroactively reduce rights in a completed purchase without consent unless required by law or necessary to address abuse or a security risk.

We aim to acknowledge consumer grievances within 48 hours and resolve them within one month, subject to the nature of the matter and applicable law.
