# Optical Flow End User License Agreement

The licence, safety allocation, purchase terms, and limitations for Dronaware Optical Flow firmware.

## 1. Dronaware and acceptance

**Dronaware** is the trading name of **Tushar Sharma**, sole proprietor, and an Udyam-registered MSME in India. "Dronaware", "we", and "us" refer to Tushar Sharma trading as Dronaware. By completing the purchase, accepting these terms at checkout where presented, starting a flashing session, activating, or using Optical Flow, you agree to this agreement and the linked Privacy and Refund policies. If you act for an organization, you represent that you can bind it.

## 2. Device licence

After valid payment and identity verification, Dronaware grants the purchaser a limited, non-exclusive, perpetual licence to use the purchased Optical Flow firmware on one registered supported device. The licence permits individual and commercial operation, internal evaluation, and the physical-device sales described below. The firmware is licensed, not sold; no ownership of source code, algorithms, binaries, documentation, or Dronaware intellectual property transfers to you.

The purchaser may, without further permission, royalty, or licence fee from Dronaware, sell, resell, distribute, lease, or otherwise supply the physical device on which the firmware was activated, including as a component of a larger commercial or OEM product. Each lawful owner or operator of that physical device may run the installed firmware solely on that registered device. This operational permission follows possession of that physical device only; it is not a separately transferable or redistributable licence or entitlement. A physical-device sale does not create another activation, permit registration of another device, or grant access to the purchaser's Dronaware account, purchase record, firmware artifacts, credentials, keys, or flashing session.

This physical-device sale permission is an expansion of the licence grant and applies to every valid Optical Flow device licence, including a licence purchased or activated before 25 September 2026. Dronaware waives enforcement of an earlier contractual term solely to the extent that it required Dronaware approval for, or prohibited, a physical-device sale that satisfies the conditions above. Earlier restrictions on separate firmware, licence, entitlement, key, credential, activation, or flashing distribution remain in force.

Updates are included only when Dronaware makes an update available for the same registered device through the official workflow. Unless expressly included at checkout, the licence does not include custom integration, guaranteed support, a right to obtain firmware files or keys, a separate licence for another device, sublicensing, licence or entitlement resale, firmware redistribution, or hosted flashing for third parties.

Except for distribution of a physical device expressly permitted above, and except where applicable law does not permit restriction, you must not extract, copy, share, publish, separately distribute, sell, or sublicense the firmware or licence entitlement; move or reproduce the firmware on another device; reverse engineer, decompile, disassemble, or create derivative works; remove notices; bypass activation or access controls; or enable another person to do so.

Third-party software components are licensed directly under their respective open-source licences. To the extent this agreement conflicts with an applicable third-party licence, that third-party licence controls for the affected component only. It does not grant any right to Dronaware's proprietary code, firmware, licence entitlement, keys, services, or branding. ## 3. Purchase, delivery, updates, and physical-device sales

Price, currency, taxes, quantity, supported hardware, and included release are shown at checkout. Payment may be handled by the payment provider or merchant of record identified at checkout. Digital delivery may include identity verification, registration instructions, a time-limited flashing session, documentation, and licence records. The raw firmware is not promised as a downloadable file. You must protect email, identity-provider, purchase, device, and flashing-session credentials and provide accurate information.

Selling or supplying a permitted physical device does not make the seller a distributor, reseller, or agent of Dronaware's firmware and does not authorize the seller to make promises on Dronaware's behalf. Dronaware approval is not required for the physical-device sale itself. The person placing the resulting hardware or larger product on the market remains responsible for its design, regulatory compliance, product claims, instructions, support, warranties, and obligations to its customers.

Refunds and failed delivery are governed by the [Refund Policy](/legal/refund). An approved refund, chargeback, or payment reversal may deactivate the related licence.

## 4. Intended use and non-safety-rated status

Optical Flow is a non-certified, non-safety-rated software component that produces relative-motion estimates for evaluation and integration by qualified developers. It is not a flight controller, navigation system, position source, obstacle- or collision-avoidance system, certified avionics product, airworthiness approval, or independent safety system.

Output may be inaccurate, delayed, stale, unavailable, discontinuous, or misleading because of hardware, lens, surface texture, lighting, altitude, vibration, motion blur, rotation, field of view, mounting, calibration, orientation, processing load, communication loss, software defects, integration, or other conditions. Do not use Optical Flow as the sole source for stabilization, navigation, positioning, collision avoidance, flight termination, or another decision where failure could cause injury or property damage.

The current firmware does not read a distance sensor, reports distance as unknown in `OPTICAL_FLOW_RAD`, and does not publish `DISTANCE_SENSOR`. It does not provide height or altitude. For stable hover, you must install and configure a separate downward distance sensor so the flight controller receives valid distance measurements at an update rate acceptable for the selected flight controller and sensor. Any future integrated distance-sensor support is outside the purchased version unless expressly included in that release.

## 5. Integrator and operator responsibilities

You are solely responsible for aircraft and system design, hardware, wiring, power, mounting, orientation, calibration, configuration, flight-controller integration, legal compliance, operating location, and deciding whether a use is safe. Before flight, you must:

- review and follow the current supported-hardware list, integration guide, operating limits, warnings, and known limitations;
- validate performance on the exact board, camera, lens, mount, aircraft, flight controller, firmware, surface, lighting, height, motion, and vibration conditions;
- reject stale, missing, low-confidence, implausible, inconsistent, or out-of-range data and implement timeouts, bounds, health monitoring, and safe fallback behaviour;
- use independent sensors or other safeguards appropriate to the risk and maintain a safe manual means of control or termination;
- complete bench, tethered, low-energy, and controlled-area testing before wider operation; and
- revalidate after any hardware, firmware, software, mounting, configuration, or environmental change.

You must not market Optical Flow or an integrated system as certified, fail-safe, guaranteed, or approved by an aviation authority unless you have independently obtained the relevant approval.

## 6. Incident records and cooperation

If you request support, a refund, indemnification, or other remedy concerning a crash or safety incident, you must promptly preserve reasonably available evidence, including the firmware and documentation version, hardware and camera model, configuration, mounting and orientation, flight-controller settings, logs, environmental conditions, test history, modifications, and incident chronology. You must not alter evidence or make a false incident report. This does not prevent honest reviews, regulatory reports, emergency communications, or lawful disclosures.

## 7. Suspension and termination

Dronaware may suspend a flashing session or licence for fraud, security threats, unauthorized distribution, activation abuse, chargeback, refund, or material breach. Where a breach is reasonably curable, we will ordinarily provide notice and a reasonable opportunity to cure. Termination does not affect accrued obligations or provisions intended to survive. A perpetual licence means the purchased version may be used indefinitely while the agreement remains in force; it does not promise perpetual service availability, updates, compatibility, or support.

## 8. Warranties

To the maximum extent permitted by law, Optical Flow and related services are provided "as is" and "as available" without implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, or suitability for any aircraft, autonomy level, mission, or regulatory approval. Published performance figures apply only to the identified test configuration and are not a guarantee for every installation. Nothing excludes an express written warranty or statutory right that cannot lawfully be excluded.

## 9. Limitation of liability

To the maximum extent permitted by law, Dronaware is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss; lost profit, revenue, data, opportunity, goodwill, aircraft, payload, use, or business; or costs of flight interruption, recovery, replacement systems, or substitute services. Dronaware's aggregate contractual liability arising from an Optical Flow entitlement will not exceed the amount paid for the entitlement giving rise to the claim.

These limitations allocate contractual risk between Dronaware and the purchaser. They do not exclude fraud, wilful misconduct, or any liability, remedy, warranty, consumer right, bodily-injury claim, product-liability claim, or third-party right that cannot lawfully be excluded or limited. No term promises immunity from claims by a person who did not accept this agreement.

## 10. Organizational-user indemnity

To the extent permitted by law, an organization purchasing or using Optical Flow will defend and indemnify Dronaware against third-party claims caused by the organization's aircraft or system design, physical product, unsupported integration, modification, regulatory non-compliance, disregard of documented limitations, misleading product representations, or unauthorized distribution of firmware or licence entitlements, except to the extent caused by Dronaware's proven defect, breach, negligence, or unlawful conduct. This section does not apply to an individual consumer where prohibited by law.

## 11. Governing terms

This agreement is governed by the laws of India, without overriding mandatory consumer protections or the jurisdiction of a court that applicable law requires. If a provision is unenforceable, the remainder continues. Changes apply prospectively through a new dated version; a completed purchase will not be retroactively deprived of its licence grant without consent, except as required by law or necessary to address fraud, abuse, or a security threat.

We aim to acknowledge consumer grievances within 48 hours and resolve them within one month, subject to the nature of the matter and applicable law.
